General conditions of use
GENERAL INFORMATION
General terms and conditions of use of the online store www.orto-bar.com are based on the Consumer Protection Act (ZVPot-1), the Personal Data Protection Act (ZVOP-2) and the Electronic Commerce on the Market Act (ZEPT).
The General Terms and Conditions determine the operation of the online store www.orto-bar, the rights and obligations of the buyer and seller in their mutual relationship. The General Terms and Conditions also regulate the rules of purchase.

The company Kir d.o.o. is entered in the court register at the District Court in Ljubljana, filing number 10719500, the company's share capital is EUR 8,763.00.
Payments with credit and payment cards are made through the Saferpay system using a secure SSL connection.
The customer is bound by the general conditions valid at the time of purchase (submission of the online order). When placing an order, the user is specifically reminded of the general business terms and conditions and confirms his familiarity with them by placing the order. The general terms and conditions of business are also available for inspection at the seller's address in printed form and marked with the date of change. The seller reserves the right to change the general terms and conditions of business, and the general terms and conditions of business that were valid at the time of purchase shall apply to each other. The competent court in Ljubljana is competent to resolve any disputes.
AVAILABILITY OF INFORMATION PRIOR TO CONCLUSION OF CONTRACT
The seller undertakes to provide the buyer with the following information before concluding the contract:
- main characteristics of the event at Orto Bar to which the tickets relate (event location - the space in Orto Bar where the event will take place, event date, opening time of the venue, estimated start time of the event, estimated end time of the event and performing artist),
- company, company headquarters, email address and company telephone number of the organizer,
- the final price of tickets for events at Orto Bar, in €, including taxes in advance sales and the marked price on the day of the event, which is usually higher or equal,
- information about the appeals procedure.
PURCHASE TICKETS IN THE ONLINE STORE WWW.ORTO-BAR
- Find your event/events.
- Press “Add ticket to cart”/ “or more from the event”.
- Once you have added the ticket to your cart, press “View Cart”.
- Select the number of tickets.
- Press Proceed to checkout.
- Enter your information to process your order.

CREDIT CARD, - Press “buy now”:
- If you have chosen to pay by card, upon successful transaction, you will receive the ordered and paid number of tickets for one or more events to the email address you provided for order processing purposes.
- If you have chosen to pay with a UPN payment order to our bank account, you will receive payment instructions to your email upon ordering. Payment with a UPN payment order must be made within 24 hours of receiving the payment instructions, otherwise the Seller does not guarantee the availability of tickets. Payment with a UPN payment order based on a timely order must be made at least two business days before the date of the selected event. After receiving payment, you will receive the ordered and paid number of tickets for one or more events to the email address you provided for order processing purposes. Otherwise, the buyer is not entitled to a refund of money and tickets.
FUNDS OF PAYMENT
- The seller's full range of means of payment includes:

- When paying with credit cards online, it is necessary to enter information about the no. cards, validity and CVC codes.
- WARNING: Payment by credit/debit card is made on the bank's website! All payment terms and security protocols are determined and enforced by the bank.
PRINT@HOME TICKET
The seller's full range of payment methods includes:
- credit and debit cards (Eurocard/Mastercard, Visa),
- UPN payment order.
When paying with credit cards online, it is necessary to enter information about the no. cards, validity and CVC codes.
WARNING: Payment by credit/debit card is made on the bank's website! All payment terms and security protocols are determined and enforced by the bank.
PRINT@HOME TICKET
Print@home tickets are saved in a PDF file, which requires at least Adobe Reader 7.0 installed on your computer.
When you enter the event at Orto Bar, we will check your Print@home ticket with a barcode reader and exchange it for a wristband that will allow you to move freely around the venue.
TICKET SECURITY
Tickets may not be misused, copied or altered. An individual ticket is valid upon first entry to the event, which means that the first ticket accepted with its identification (barcode) is valid. Do not publish the ticket barcode and protect it appropriately, both against loss and physical damage or unauthorized copying and forwarding. All subsequent tickets with the same identification are automatically invalid. By using an authorized ticket, the user accepts the general terms and conditions of the event organizer and the rules of the institution where the event takes place (Orto bar).
In the event of lost or stolen tickets, the buyer is not entitled to a refund, exchange or replacement ticket.
ONLINE TICKET PURCHASE IS COMPLETE
- Before clicking on Payment, the buyer is obliged to carefully check all purchase information (date, time, method of ticket collection and purchase amount, performing artist).
- After completing the ticket purchase, which is done directly after clicking on payment when purchasing online, changes or cancellations are no longer possible.
TICKET COMPLAINTS
In accordance with point 12 of Article 135 of the Consumer Protection Act (Official Gazette of the Republic of Slovenia, No. 130/22), the consumer does not have the right to withdraw from the contract for leisure services where the company undertakes to fulfill its obligation on a specific date or within a specific period. Given the aforementioned legal exception, according to which the consumer does not have the right to withdraw from the purchase of tickets that were purchased through an online store www.orto-bar or physically at the Orto bar and request a refund for them.
In the event of cancellation of an event at Orto Bar organized by Kir d.o.o. or a change in the date of such an event, Kir d.o.o. will organize a refund or inform customers of an alternative date for the event.
In the event that the event at Orto Bar is organized by other organizers who sell tickets through other sellers, the buyer must contact the event organizer.
It is the buyer's duty to check the validity of the date, time and location of the event for which they purchased the ticket.

OUT OF COURT RESOLUTION OF CONSUMER DISPUTES
In accordance with legal regulations, Kir d.o.o. does not recognize any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer could initiate in accordance with the Out-of-Court Consumer Dispute Resolution Act.
Kir d.o.o enables online shopping in the Republic of Slovenia, and here in its general terms and conditions it publishes an electronic link to the platform for online consumer dispute resolution (SRPS): https://ec.europa.eu/consumers/odr
The aforementioned regulation comes from the Act on the Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on the online resolution of consumer disputes and the amendment of Regulation (EC) no. 2016/2004 and Directive 2009/22/EC.
PERSONAL DATA
When purchasing a ticket, the buyer agrees that the data he will transmit electronically will be used by the seller for the purpose of fulfilling the order and informing, as stated in the legal notice on the protection of personal data. The company Kir d.o.o. is committed to the permanent protection of all personal data of the buyer in accordance with the Personal Data Protection Act and the GDPR regulation.
COLLECTION OF PERSONAL DATA
Personal data is collected when the buyer enters their personal data on the seller's online store. If you wish to purchase tickets via the seller's website, you must enter your first and last name, address and email address, to which we will send an electronic ticket in pdf format with a barcode after the purchase.
USE OF PERSONAL DATA
Personal data collected through the seller's online store is used to operate the site and provide services or carry out transactions that you have requested or consented to. This is the sale of an electronic ticket for an event at Orto Bar, or you have signed up for our E-newsletter. PROTECTION OF PERSONAL DATA
The Seller will not provide personal information to third parties without your consent. The Seller protects personal information. The Seller uses various technology and procedures to help protect your personal information from unauthorized access, use or disclosure. The personal information you provide is stored on servers that are accessible only to authorized persons and are located in secure facilities.
When you submit sensitive data or information (e.g. credit card number) over the Internet, you are on the website of a bank or payment processor, where encryption, SSL (Security Socket Layer) protocol is used. The data is entered and stored solely for the purpose of selling electronic tickets. SECOND
- The validity period of the offer is determined by the seller, as well as the prices, which are valid until cancellation. The seller is liable for VAT from the organization of the event. The list of transactions is kept in electronic form by the seller.
PRIVACY POLICY CHANGES
- Seller reserves the right to change this policy at any time. In doing so, we will always notify you of a substantive change to the policy by publishing the change on the home page of the website or by sending you a notice of the change.
RESPONSIBILITY
- The information published on the seller's website is for informational purposes only. The seller, as an intermediary in the sale, does not assume any responsibility that this information is complete, correct in content and up-to-date. Photos, multimedia content, documents and descriptions do not guarantee event properties.
ORTO BAR RULES
Visitors who show visible signs of intoxication may be prohibited from entering the Orto bar. Minors (under the age of 16) are not allowed to enter the Orto bar, except when they are accompanied by their parents. Minors over the age of 16 must leave the bar by midnight. In the Orto bar, we do not serve alcoholic beverages and other drinks to which alcoholic beverages have been added to persons under the age of 18, and we do not sell tobacco products to them. We do not serve alcoholic beverages to people who show obvious signs of intoxication. We do not serve or sell alcoholic beverages to persons who can be reasonably assumed to be passing them on to persons under the age of 18. Guests of the Orto bar are asked not to bring their own drinks into the area of the bar. The area of the bar is the driveway, the terrace, the yard in front of the bar and the bar itself. Also, please do not pollute the listed surfaces with your waste. Orto bar is under video surveillance! According to the law, it is not possible to take drinks out of the bar after 24:00, because serving outside is only allowed until 24:00!
THE USE OF HEARING PROTECTION (HEADMUDGUARDS OR EARPLUGS) AT CONCERTS IN ORTO BAR IS MANDATORY FOR MINORS!
REGULATIONS ON THE STORAGE OF CLOTHING AND OTHER THINGS IN ORTO BAR
The cost of keeping one thing in the wardrobe is 2€. For a lost wardrobe number, we charge €5. When entering the Orto bar, it is mandatory to hand in backpacks, bags, suitcases and other large luggage. The reason is for the general safety of guests. When leaving things for safekeeping, the guest receives a number, which he must keep carefully as proof that he has left the thing for safekeeping in the cloakroom in the Orto bar. A cloakroom number is always issued for only one item that the guest leaves for safekeeping. This is for the sake of transparency over the given things. The cloakroom number is always issued only to the guest who is the owner of the given item. If the guest does not present the wardrobe number when picking up things from the cloakroom, or if he does not have any other proof that he left the thing for safekeeping, the authorized person does not release the things until the bar closes, when the identity can be more easily established. All things found in the Orto bar are kept in the wardrobe. We keep found things for 14 days. The caterer is responsible for things stored in the cloakroom if the damage was caused by his fault or the fault of an authorized person. The caterer's liability is excluded if things were destroyed or damaged due to circumstances that could not be avoided or prevented. Or due to some cause in itself things.Or if they disappeared or were damaged due to the fault of the guest himself or due to the fault of those the guest brought with him. When leaving things for safekeeping in the Orto bar, guests must not put drinks on the locker shelf or enter the locker room without authorization.
SMOKING ROOM RULES
Food and drinks are not allowed in the smoking room. The smoking room is intended exclusively for smoking, service is not permitted in the room. The maximum number of people allowed in the smoking room is 35.
